Welcome to Gengoya Daily (言語屋デイリー / 每日言语屋), an iOS Japanese-vocabulary app provided by Otters Lab ("we," "us," or "our"). These Terms of Use ("Terms") are a legal agreement between you and us governing your use of the Gengoya Daily app (the "App"). They are consistent with Apple's standard Licensed Application End User License Agreement. Please read them together with our Privacy Policy.
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App. If you are using the App on behalf of someone else, you confirm you are authorized to accept these Terms on their behalf.
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, in accordance with the Apple Media Services Terms and Conditions and these Terms. This license is for your personal, non-commercial use only.
Gengoya Daily offers optional in-app purchases: individual illustrated word-card packs, and a one-time "Unlock All" option.

The App, including its design, layout, software, text, and all illustrations and word-card artwork, is owned by or licensed to Otters Lab and is protected by copyright and other intellectual property laws. The illustrations and content are the copyrighted property of Otters Lab. These Terms do not grant you any rights to our trademarks, illustrations, or content except for the limited, personal license described above.
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free, uninterrupted, or that any vocabulary, translation, or pronunciation it provides is complete or accurate.
To the fullest extent permitted by law, Otters Lab will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or related to your use of the App. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
These Terms apply until terminated. Your license ends automatically if you fail to comply with them. You may end it at any time by deleting the App. Upon termination, you must stop using the App; the disclaimers, limitation of liability, and intellectual-property provisions survive. Deleting the App removes its locally stored data from your device, but purchases recorded by your Apple account remain restorable.
These Terms are governed by the laws of Japan, without regard to its conflict of law rules. Any disputes will be subject to the courts located in Japan, unless applicable law grants you the right to bring proceedings elsewhere.
We may update these Terms from time to time. When we do, we will revise the "Effective date" above and post the updated Terms at otterslab.com. Your continued use of the App after changes take effect means you accept the updated Terms.

本アプリをダウンロード、インストール、または使用することにより、お客様は本規約に拘束されることに同意したものとみなされます。 同意いただけない場合は、本アプリをご使用にならないでください。 他者を代理して本アプリを使用する場合、お客様はその者を代理して本規約に同意する権限を有することを表明するものとします。
当社は、Apple メディアサービス利用規約および本規約に従い、お客様が所有または管理する Apple デバイス上で本アプリをダウンロードおよび使用するための、 個人的・限定的・非独占的・譲渡不可・取消可能な使用許諾をお客様に付与します。 本許諾は、お客様の個人的かつ非商業的な使用のみを目的とします。
Gengoya Daily は、任意のアプリ内課金を提供します。個別のイラスト付き単語カードパック、および一回限りの「すべて解除」オプションです。
お客様は、以下の行為を行わないことに同意します。
本アプリ（そのデザイン、レイアウト、ソフトウェア、テキスト、ならびにすべてのイラストおよび単語カードのアートワークを含む）は、 Otters Lab が所有またはライセンスを受けたものであり、著作権その他の知的財産法によって保護されています。 イラストおよびコンテンツは Otters Lab が著作権を有する財産です。本規約は、上記の限定的かつ個人的な使用許諾を除き、 当社の商標、イラスト、コンテンツに対するいかなる権利もお客様に付与しません。
本アプリは「現状有姿」かつ「提供可能な範囲」で提供され、商品性、特定目的への適合性、非侵害を含む、明示または黙示を問わずいかなる保証も伴いません。 当社は、本アプリにエラーがないこと、中断されないこと、または提供される単語・翻訳・発音が完全もしくは正確であることを保証しません。
法律で認められる最大限の範囲において、Otters Lab は、お客様による本アプリの使用に起因または関連して生じた、 間接的・付随的・特別・結果的・懲罰的損害、またはデータの損失について、一切責任を負いません。 一部の法域では特定の制限が認められていないため、上記の一部がお客様に適用されない場合があります。
本規約は、終了するまで適用されます。お客様が本規約を遵守しない場合、お客様の使用許諾は自動的に終了します。 お客様は、本アプリを削除することでいつでも終了させることができます。終了後、お客様は本アプリの使用を停止しなければなりません。 免責事項、責任の制限、知的財産に関する条項は終了後も存続します。 本アプリを削除すると、デバイス上にローカル保存されたデータは削除されますが、Apple アカウントに記録された購入は引き続き復元可能です。
本規約は、抵触法の原則にかかわらず、日本の法律に準拠します。 適用法によりお客様が他の場所で手続きを行う権利が認められる場合を除き、いかなる紛争も日本に所在する裁判所を管轄とします。
当社は本規約を随時更新する場合があります。その際は、上部の「発効日」を改訂し、更新後の規約を otterslab.com に掲載します。 変更の発効後にお客様が本アプリの使用を継続した場合、更新後の規約に同意したものとみなされます。

本应用按“现状”和“现有”基础提供，不附带任何明示或默示的保证，包括适销性、特定用途适用性和不侵权。 我们不保证应用无错误、不会中断，也不保证其提供的任何单词、翻译或发音完整或准确。
在法律允许的最大范围内，Otters Lab 对因您使用本应用而引起或与之相关的任何间接、附带、特殊、后果性或惩罚性损害， 或任何数据丢失，概不负责。部分司法管辖区不允许某些限制，因此上述部分内容可能不适用于您。
本条款在终止前持续有效。如您未能遵守本条款，您的许可将自动终止。您可以随时通过删除应用予以终止。 终止后，您必须停止使用本应用；免责声明、责任限制及知识产权相关条款将在终止后继续有效。 删除应用会移除其在您设备上本地存储的数据，但您 Apple 账户中记录的购买仍可恢复。
本条款受日本法律管辖，不考虑其法律冲突规则。 除适用法律赋予您在其他地点提起诉讼的权利外，任何争议均应提交至位于日本的法院处理。
我们可能会不时更新本条款。届时，我们会修订上方的“生效日期”，并在 otterslab.com 发布更新后的条款。 变更生效后您继续使用本应用，即表示您接受更新后的条款。
